The NBA-YLF Continuing Legal Education (CLE) Committee is pleased to bring to the attention of members a recent and significant decision of the Supreme Court in Suleiman Abubakar & Anor v. Providus Bank Limited & 9 Ors (SC/CV/132/2026), the Court invoked its powers under Section 22 of the Supreme Court Act and sanctioned a merger between 2 banks.
It was also held that:
1. A ground of appeal involving the valuation of evidence, examination of facts, or the exercise of discretion is one of mixed law and fact.
2. In computing the time for filing a notice of appeal, the day judgment is delivered is excluded.
3. Courts possess inherent powers to regulate their processes and may order an accelerated hearing without requiring further addresses from
counsel.
4. Costs are awarded to compensate a successful litigant for the trouble, harassment and inconvenience he has been subject to unnecessarily
